Privacy & Data Protection Policy

How we collect, use, protect, and retain your information.

1. Introduction & Scope

This Privacy & Data Protection Policy ("Policy") explains how Freeman Addico ("we", "us", "our"), trading as Freeman Addico Sovereign Intelligence, collects, uses, stores, and protects personal and confidential information when you visit our website, complete an assessment, request a consultation, book an engagement, or otherwise engage our advisory services.

We operate in a high-trust, high-discretion environment. Protecting your information is not only a legal obligation — it is central to the service we provide. This Policy applies to all visitors, prospective clients, and engaged clients ("you") wherever you are located.

We serve clients across Africa and internationally. We process your information in accordance with the data-protection laws applicable in the jurisdictions in which we operate, including the laws of the Republic of Ghana and, where relevant, the data-protection laws of your own jurisdiction.

2. Information We Collect

Information you provide directly: full name, email address, role, company, assessment responses, booking details, and any information you share in consultations or correspondence.

Information collected automatically: IP address, browser type, device information, pages visited, and usage analytics. We use cookies and similar technologies as described below.

Information generated through engagements: risk scores, assessment results, advisory notes, and records of work performed — all treated as confidential client information.

3. How We Use Your Information

To respond to enquiries, schedule and deliver advisory engagements, and provide the services you request.

To compute your Executive Trust Score and produce assessment reports and recommendations.

To communicate with you about your engagement, send relevant updates, and improve our services.

To maintain records required for the proper provision and oversight of our advisory work, and to comply with applicable legal and regulatory obligations.

We do not sell your personal information to third parties, and we do not use your information to train external artificial-intelligence models.

4. Legal Basis for Processing

We process your personal information on the basis of: (a) your consent, given when you submit your details; (b) the performance of a contract or pre-contractual steps for an engagement you request; (c) our legitimate interests in operating and improving our practice; and (d) compliance with legal obligations.

You may withdraw consent at any time by contacting us. Withdrawing consent does not affect the lawfulness of processing already carried out.

5. Data Sharing & Disclosure

We share information only on a strict need-to-know basis: with trusted service providers who help us operate (for example scheduling and calendar tools), under appropriate confidentiality and data-protection terms.

We may disclose information where required by law, court order, or competent authority, or to protect our rights, property, or safety, or that of others.

Apart from the above, your assessment results and engagement details are held in confidence and are not shared with third parties without your consent.

6. Data Retention

We retain personal information only for as long as necessary to fulfil the purposes described in this Policy, including for the duration of an engagement and a reasonable period thereafter for record-keeping and legal compliance.

Prospective-client enquiry data that does not result in an engagement is retained for a limited period and then deleted or anonymised.

You may request early deletion of your data subject to any legal retention obligations.

7. Data Security

Given the sensitive nature of executive risk advisory, we apply organisational and technical measures designed to protect your information against unauthorised access, alteration, disclosure, or loss, including access controls, encryption in transit, and restricted internal access.

No method of transmission or storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security.

8. International Transfers

Your information may be processed in countries other than your own, including where our service providers are located. Where this occurs, we take steps designed to ensure your information receives an adequate level of protection consistent with this Policy, and, where required, we put appropriate safeguards in place (such as standard contractual clauses) for such transfers.

9. Your Rights

Subject to applicable law, you may have the right to: access your personal information; request correction of inaccurate data; request deletion; object to or restrict certain processing; withdraw consent; and lodge a complaint with a supervisory authority.

10. Cookies & Analytics

We use cookies and analytics to understand how the site is used and to improve it. You can control or disable cookies through your browser settings; some features may not function correctly if cookies are disabled.

11. Children’s Privacy

Our services are intended for adults and organisations. We do not knowingly collect personal information from children. If you believe a child has provided us with personal data, please contact us so we can delete it.

12. Third-Party Links & Services

Our site may link to third-party services (for example scheduling tools). We are not responsible for the privacy practices of third parties; please review their policies separately.

13. Changes to This Policy

We may update this Policy from time to time. We will indicate the effective date above and, where appropriate, notify you of material changes. Continued use of our site or services after a change constitutes acceptance of the updated Policy.

Terms of Use

The terms that govern your use of our website and advisory services.

1. Acceptance of Terms

By accessing or using the Freeman Addico website or engaging our advisory services, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the site or services.

Specific engagements may be governed by a separate written engagement agreement or statement of work. Where a written engagement agreement applies, it takes precedence over these Terms to the extent of any conflict.

2. Description of Services

Freeman Addico provides executive cybersecurity, digital-identity protection, and strategic intelligence advisory services, including the Executive Trust Assessment, digital risk reviews, protection advisory, and board advisory.

Our services are advisory in nature. They provide guidance, analysis, and recommendations based on the information available to us at the time.

3. Eligibility & Authority

You represent that you are at least 18 years of age, have the legal capacity to enter into these Terms, and where you act on behalf of an organisation, you have the authority to bind that organisation.

4. Advisory Nature — No Guaranteed Outcomes

Advisory services involve professional judgement applied to evolving facts and threats. We do not guarantee any specific outcome, result, score, or the prevention of any incident, loss, or breach.

Your Trust Score, risk classification, and recommendations are informational and advisory only; they are not a certification, warranty, or assurance of security.

5. Engagements & Fees

Fees, scope, and terms for specific engagements are agreed separately, typically in an engagement letter or statement of work. Unless otherwise agreed, fees are payable as set out in that agreement and in our Refund & Cancellation Policy.

6. Client Responsibilities & Information Accuracy

You agree to provide accurate, complete, and timely information. The quality of our advice depends on the accuracy of the information you provide; we are not liable for outcomes arising from incomplete or inaccurate information you supply.

You are responsible for implementing recommendations and for decisions you make based on our advice.

7. Confidentiality

We treat engagement information as confidential, consistent with this Policy and any engagement agreement. You similarly agree to keep our methodologies, recommendations, and materials confidential where they are not otherwise public.

8. Intellectual Property

All content on this site — including text, graphics, logos, assessment frameworks, and reports — is owned by or licensed to Freeman Addico and protected by intellectual-property laws. You may not copy, reproduce, or redistribute our materials without prior written permission, except to use reports delivered to you for your own internal purposes.

9. Prohibited Conduct

You agree not to: misuse the site or services; attempt to gain unauthorised access to systems or data; use our services for any unlawful purpose; scrape or harvest content; or interfere with the proper operation of the site.

10. Third-Party Services

We may use or link to third-party tools (for example scheduling and calendar services). We are not responsible for their availability, accuracy, or conduct, and your use of them is subject to their own terms.

11. Disclaimers

The site and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 12. Limitation of Liability

To the fullest extent permitted by law, Freeman Addico shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business, arising from your use of the site or services.

Our aggregate liability for any claim arising out of or relating to the services is limited to the fees you paid us for the engagement giving rise to the claim, or where no fee was paid, to a nominal amount. Nothing in these Terms limits liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold Freeman Addico harmless from any claims, damages, or expenses arising from your misuse of the site or services, your breach of these Terms, or your violation of any law or third-party right.

14. Termination

We may suspend or terminate access to the site or services at any time, including for breach of these Terms. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will remain in effect.

15. Governing Law & Dispute Resolution

These Terms apply to clients and visitors worldwide, regardless of their location. They, and any dispute arising out of or relating to them or the services, are governed by the laws of the Republic of Ghana, without regard to conflict-of-laws principles.

Before any formal proceedings, the parties shall attempt in good faith to resolve any dispute through negotiation. If a dispute remains unresolved after 30 days, it shall be finally resolved by arbitration administered under the ICC Rules of Arbitration then in force, by one or three arbitrators appointed in accordance with those Rules.

The seat of arbitration shall be Johannesburg, South Africa (or another seat the parties agree in writing). The language of the arbitration shall be English, and Ghanaian law shall govern the substance of the dispute. The resulting award shall be final and binding and may be enforced in any court of competent jurisdiction under the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards (1958) and any other applicable enforcement treaty.

Notwithstanding the above, either party may seek interim or injunctive relief from any court of competent jurisdiction to protect its rights, and the courts of South Africa shall have non-exclusive jurisdiction for such purposes.

16. Changes to These Terms

We may update these Terms from time to time. The effective date above reflects the latest version. Continued use of the site or services after changes constitutes acceptance of the updated Terms.

Refund & Cancellation Policy

Our approach to deposits, cancellations, and refunds for advisory engagements.

1. Overview

Freeman Addico provides bespoke professional advisory services. Because our work is tailored, time-intensive, and often begins immediately upon engagement, refunds are handled as set out below and in any applicable engagement agreement.

2. Deposits & Retainers

Where a deposit or retainer is required to secure or commence an engagement, it is payable in advance. Unless your engagement agreement states otherwise, deposits and retainers reserve our availability and the commencement of work, and are applied toward the engagement fees.

3. Cancellation by Client

If you cancel an engagement, you may be entitled to a refund of any unearned portion of a retainer, calculated on a pro-rata basis for work not yet performed.

Work already performed, time already committed, and any third-party costs incurred on your behalf up to the point of cancellation are non-refundable.

For scheduled consultations, cancellations made at least 48 hours before the appointment may be rescheduled without charge. Cancellations within 48 hours may be subject to the full session fee.

4. Non-Refundable Items

The following are non-refundable once commenced or delivered: completed assessments and Trust Score reports, advisory sessions already held, written deliverables, research and analysis already performed, and any third-party costs incurred on your behalf.

5. Cancellation by Us

If we must cancel or terminate an engagement for reasons other than your breach, we will refund any unearned fees you have paid. If we terminate due to your breach of these Terms or an engagement agreement, fees for work performed remain payable and non-refundable.

6. Digital Products & Resources

Due to the immediate availability and downloadable nature of digital reports and resources, these are non-refundable once access has been provided, except where required by applicable law.

7. How to Request a Refund

To request a refund, contact us at hello@freemanaddico.com with your engagement details. We will review your request and respond within a reasonable time, typically 10 business days.

8. Processing Time

Approved refunds will be processed using the original payment method within 14 days of approval, subject to the timelines of your payment provider.

9. Statutory Rights

Nothing in this Policy restricts any statutory rights you may have under applicable consumer-protection law, which cannot be excluded.

10. Changes

We may update this Policy from time to time. The version applicable to your engagement is the one in effect when you booked or paid, unless your engagement agreement provides otherwise.

Disclaimer & Limitation of Liability

Important limits on our advice and liability you should understand.

1. Advisory — Not Legal, Financial, or Investigative Advice

The services, assessments, reports, and content provided by Freeman Addico are advisory and informational. They do not constitute, and are not a substitute for, legal advice, financial advice, accounting advice, or licensed investigative services.

You should consult qualified professionals in the relevant field before making decisions based on our guidance.

2. No Warranty of Results

Cybersecurity and digital-identity risk are dynamic. No service can guarantee that an incident, breach, or loss will not occur. We make no warranty, express or implied, that our services will achieve any particular result or that any risk will be eliminated.

3. Information Accuracy

We strive for accuracy, but information on this site and in our reports may become outdated or may, despite our efforts, contain errors. You should verify critical information before relying on it. We are not liable for any loss arising from reliance on information provided through our services.

4. Third-Party Tools & Content

We may reference, integrate, or rely on third-party tools, data, and services. We do not control and are not responsible for their accuracy, availability, or security, and your use of them is at your own risk.

5. Assumption of Risk

You acknowledge that engaging with cybersecurity and risk advisory involves inherent uncertainties, and you assume responsibility for decisions made and actions taken (or not taken) based on our advice.

6. Limitation of Liability

To the fullest extent permitted by law, Freeman Addico, its principals, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, reputation, or business opportunity, arising from or related to the use of our site or services, even if advised of the possibility of such damages.

Our total aggregate liability for any claim is limited to the amount you paid us for the engagement giving rise to the claim, or where no fee was paid, to a nominal amount. This limitation applies even if a remedy fails of its essential purpose.

Nothing in this Disclaimer excludes or limits liability that cannot be excluded under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation).

7. Indemnification

You agree to indemnify and hold Freeman Addico harmless from claims, damages, costs, and expenses arising from your use of the site or services, your breach of these terms, or your violation of any law or third-party right.

8. Severability

If any provision of this Disclaimer is found to be unenforceable, the remaining provisions will continue in full force and effect.
